Consumer Health Data Privacy

WASHINGTON CONSUMER HEALTH DATA PRIVACY POLICY

This Washington Consumer Health Data Privacy Policy applies to consumer health data that Myfitsociety processes and that is subject to the Washington My Health My Data Act.

“Consumer health data” has the meaning provided under the Washington My Health My Data Act.

1. CONSUMER HEALTH DATA WE COLLECT AND HOW WE USE IT

Depending on the features you choose to use, Myfitsociety may collect the following categories of consumer health data:

Fitness and Activity Information

This may include workouts, exercises, steps, running and cycling activity, distance, duration, pace, calories burned, heart rate where available through a connected service, fitness level, and other activity information.

We use this information to provide activity tracking, workout features, progress tracking, personalized recommendations, and related fitness functionality.

Body and Measurement Information

This may include height, weight, body fat information, body measurements, progress information, fitness goals, and information derived from body analysis features.

We use this information to provide progress tracking, body composition features, personalized fitness recommendations, and other requested features.

Nutrition Information

This may include food entries, food or meal photos, calorie and macronutrient information, nutrition goals, and information generated through food analysis features.

We use this information to provide food tracking, calorie and nutrition estimates, nutrition goals, personalized recommendations, and related features.

Menstrual and Reproductive Wellness Information

If you choose to use menstrual-cycle features, this may include period dates, cycle information, predictions, and related information that you provide.

We use this information to provide the menstrual-cycle tracking and prediction features you request.

Sleep and Fasting Information

This may include sleep duration, sleep sessions, fasting periods, fasting history, and related wellness information.

We use this information to provide sleep, fasting, progress, and wellness tracking features.

Photos and Images

If you choose to use features involving progress photos, body photos, food photos, or similar images, those images may contain or reveal consumer health data.

We use those images to provide the feature for which they were submitted, including progress tracking, food analysis, or body analysis.

AI Feature Information

Information you provide through AI-powered features may include health, fitness, nutrition, body, goal, and wellness information.

We use this information to provide the AI feature requested by you, including food analysis, body analysis, and AI Coach functionality.

Connected Fitness Service Information

If you choose to connect supported fitness services, we may collect information you authorize those services to provide.

Depending on the service, this may include steps, sleep, workouts, activity information, distance, duration, calories, pace, elevation, heart rate, and related fitness information.

We use this information to provide the connected fitness and activity features you request.

2. SOURCES OF CONSUMER HEALTH DATA

We may collect consumer health data from the following categories of sources:

  • directly from you when you enter or upload information to Myfitsociety;
  • from your use of Myfitsociety features;
  • from device motion, step, or activity functionality that you authorize;
  • from Google Health Connect when you authorize a connection;
  • from Strava when you authorize a connection;
  • from Garmin when you authorize a connection;
  • from photos or other content you choose to submit;
  • from AI-powered features that analyze information you provide; and
  • from information generated from or derived from your use of requested Myfitsociety health, fitness, nutrition, and wellness features.

3. CONSUMER HEALTH DATA WE SHARE

Myfitsociety does not sell consumer health data.

We do not share consumer health data for targeted or behavioral advertising.

We may disclose consumer health data to processors or service providers acting on our behalf where reasonably necessary to provide a product or service you request, including infrastructure, storage, artificial intelligence, technical operations, and related service providers.

We may also disclose information where you specifically direct or request the disclosure, or where otherwise permitted or required under the Washington My Health My Data Act.

Under the definitions in the Washington My Health My Data Act, certain disclosures to processors or disclosures necessary to provide a product or service requested by the consumer may not constitute “sharing.”

We do not currently share consumer health data with any specific Myfitsociety affiliate in a manner treated as “sharing” under the Washington My Health My Data Act.

4. YOUR WASHINGTON CONSUMER HEALTH DATA RIGHTS

Subject to applicable law, you may have the right to:

  • confirm whether we are collecting, sharing, or selling consumer health data concerning you;
  • access consumer health data concerning you;
  • receive information about applicable third parties or affiliates with whom your consumer health data has been shared or sold;
  • withdraw consent to future collection or sharing where processing is based on your consent; and
  • request deletion of consumer health data concerning you.

You will not be unlawfully discriminated against for exercising rights provided by the Washington My Health My Data Act.

5. HOW TO EXERCISE YOUR RIGHTS

You may submit a Washington consumer health data request by contacting:

Please state that your request concerns your Washington Consumer Health Data Rights and provide sufficient information for us to identify and authenticate your request.

You are not required to create a new Myfitsociety account to exercise these rights. If you already have an account, we may use reasonable account authentication methods to verify your request.

We may request additional information where reasonably necessary to authenticate your identity and protect consumer health data from unauthorized access or deletion.

Where applicable, we will respond to an authenticated request without undue delay and within the period required by Washington law.

Deletion requests may require additional time for consumer health data contained in archived or backup systems as permitted by Washington law.

6. APPEALS

If we decline to take action on a Washington consumer health data request, you may appeal our decision by contacting:

Please identify your request as an Appeal of Washington Consumer Health Data Request and include sufficient information for us to identify the original request.

We will review and respond to the appeal as required by applicable Washington law.

If an appeal is denied, we will provide information about how you may contact the Washington State Attorney General where required.
